What happens in a sale?

Many of our clients ask what does the conveyancing process look like? Well, just like each property and each individual’s circumstances differ, so does the exact conveyancing of each property. Although having said that, all transactions follow a similar set of steps.

Quoting and Instruction – a quote is agreed with the team here at Express Conveyancing to work with our conveyancing solicitors Islington. We work on the basis of fixed and transparent fees, with any transaction variations being discussed and agreed with you.

Client care paperwork – Your appointed conveyancing solicitor will send initial paperwork to you, which you will need to complete and return with ID and source of funds documentation. There will also be some property specific documents you will need to complete, such fixtures and fittings forms.

Draft contracts – Your conveyancing solicitor will draft contracts and send these across to your buyers solicitor for review.

Enquiries – The buyer’s solicitor will raise legal enquiries on the property and its title, which will be responded to you by your solicitor. Some will be technical in nature and so the solicitor will respond, some may be more practical and will require input from you.

Redemption of any financial charges – If you have a mortgage or other financial charge on the property, your conveyancer will be responsible for redeeming any outstanding finance on completion and ensuring the formalities are carried out so the charge is released and not carried over to the new buyer.

Exchange and completion – Once the buyer’s solicitor is happy with all enquiries and any financial charges have been dealt with, dates for exchange and completion will be discussed and agreed on both sides. The two solicitors will then carry out the exchange of signed contracts and then eventually complete the transaction, so you can move out and the buyer can move in.

What happens in a purchase?

Like a sale, a purchase follows a similar process with specific differences for each property and individual circumstances.

Quoting and Instruction – just like in a sale, your quote is agreed with the team here noting any specifics of your transaction, such as mortgages, gifted deposits or whether the property is a new build, freehold, leasehold etc.

Client care paperwork – You will need to complete the initial paperwork including details about the SDLT eligibility and financial arrangements and will need to supply supporting documentation.

Draft contracts – Your conveyancing solicitor will receive draft contracts from the sellers solicitor and will review all title and legal information about the property and proposed transaction terms.

Searches and Enquiries – Your solicitor will request property searches are carried out, with the Local Authority, water and environmental agencies. They will also raise legal questions or enquiries about the property. You can also raise any questions you have also. The sellers solicitor will respond with the assistance of the seller and your solicitor will then judge if the response is satisfactory. All finding will then be explained to you in the solicitors report on title.

Financial arrangements – Your solicitor will carry out the relevant checks and processes needed for any finances you require for the property. This may be discussions with mortgage lenders if there are specific requirements in relation to your property, gifted deposit checks and any formalities in relation to Help to Buy ISAs or LISAs.

Exchange and completion – Once everyone is happy to proceed, dates for exchange and completion are agreed. Your solicitor will carry out the final formalities to ensure release of funds to them and transfer across to the seller’s solicitor in turn. Keys will then be released and you can move into your new property.

THE LONDON BOROUGH OF ISLINGTON

The London Borough of Islington is considered a central London Borough and forms part of Inner London, alongside its neighbours Camden, Kensington and Chelsea, Lambeth, Southwark, and Westminster. In fact, the borough shares a border with Camden. Islington is the second smallest of the London boroughs and was formed in 1965 as part of the London Government Act 1963.

Originally named Giseldone by the Saxons in 1005, Islington has been known by numerous different names over the years until Islington was settled upon on in 1889. This name remained when the area was merged with Finsbury in forming what is now known as the London Borough of Islington.

Historically the area was known as a water source and good location for the growing of vegetables to supply the city, experienced extreme poverty during the Victorian era and lost over 3,000 of its traditional housing stock during the World War bombings. However, Islington has undergone a number of changes over the years and is now a built up important part of central London. It is this central London location that lends the borough to be part of the Central London Congestion Charging Zone and Ultra Low Emission Zone.

The London Borough of Islington is well known as the home of two well established communities, the first being a large Irish population. In fact, Islington is home to the second highest population of Irish residents next to the London Borough of Brent in West London. Clerkenwell is home to a large Italian community and is known as London’s “Little Italy” and still features a number of iconic buildings nodding to its Italian heritage such as St Peter’s Italian Church.

Besides its importance in central London, Islington is home to a number of higher and further education facilities such as the University of London City, who’s campus is found in Northampton Square and London Metropolitan University on Holloway Road. Three further education colleges are found in Islington, being London Screen Academy, City and Islington College and Westminster Kingsway College. There are also two colleges specialising in performing arts, the Urdang Academy and the Musical Theatre Academy. In addition, Moorfields Eye hospital located on City Road in Islington is a well-known location for postgraduate training for all eye specialities.

The London Borough of Islington is home to Arsenal football team which as called the area its home since its foundation in 1886. The team’s large capacity stadium has been located here since it was built in 2006. The Emirates Stadium is the fifth largest football stadium in England with a capacity of 60,704 and a full fixture list. It has also been the location of numerous music events when not in use for football.
